These Terms of Service (the “Terms”) govern your use of this website and your relationship with Activate Beauty when you book or receive our services. Please read them carefully. Nothing in these Terms is medical advice, and they do not replace the private consultation that precedes any treatment.
1 Acceptance
By using this website or by booking or receiving services from Activate Beauty, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the website or book services. You must be the age of majority in Ontario, or have the consent of a parent or legal guardian, to book or receive treatment.
2 Our services
Activate Beauty offers medical aesthetic services in Bloor West Village, Toronto. Treatments are provided within the regulatory framework of the College of Nurses of Ontario, the Regulated Health Professions Act, 1991, and applicable Health Canada regulations. Injectable treatments are performed by a regulated health professional under medical directive. The information on this website is provided for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
3 Consultation & eligibility
A private consultation is required before any treatment. During the consultation we review your medical history and assess whether a treatment is appropriate for you. Not everyone is a candidate for every treatment. Activate Beauty reserves the right to decline or postpone a treatment where it is not clinically appropriate, where eligibility cannot be confirmed, or where proceeding would be inconsistent with our professional and regulatory obligations.
4 Booking, cancellation & no-shows
Appointments are booked through JaneApp, and a deposit may be required to secure your booking. We ask that you give at least 48 hours’ notice if you need to cancel or reschedule. Cancellations made with less than 48 hours’ notice, and missed appointments (“no-shows”), may result in forfeiture of the deposit. 5 Payments
Payments are processed through JaneApp and its payment provider, Stripe. Activate Beauty does not store your full card details; only a secure token issued by Stripe is retained to process authorized charges. Fees for services and any applicable taxes are confirmed at the time of booking or treatment. Where a deposit, package, or pre-payment applies, the terms are disclosed to you before payment is taken.
6 Gift cards
Gift cards may be purchased and used toward eligible services. Gift cards are non-refundable and may be transferable, and are governed by Ontario’s Consumer Protection Act, 2002. Any additional conditions are disclosed at the time of purchase.
7 Results & expectations
Individual results vary and depend on factors unique to each person. No clinical outcome is guaranteed. We will discuss realistic expectations, the nature of the treatment, and its possible risks during your consultation, and provide written aftercare guidance where applicable. Any examples, descriptions, or general information on this website are illustrative only and are not a promise of a specific result.
8 Intellectual property
The Activate Beauty name, logo, and all original text, design, and other content on this website are the property of Activate Beauty or its licensors and are protected by applicable intellectual-property laws. You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.
9 Third-party trademarks
References on this website to third-party products — including BOTOX®, JUVÉDERM®, SCULPTRA®, RADIESSE®, and PROFHILO® — are made on a nominative basis to identify those products and the categories of treatment we may provide. Such references do not imply any affiliation with, sponsorship by, or endorsement from the trademark owners. All trademarks are the property of their respective owners.
10 Limitation of liability
To the maximum extent permitted by the laws of Ontario, the total liability of Activate Beauty for any claim arising out of or relating to these Terms, the website, or our services is limited to the amount of fees you paid to us in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law — including the Consumer Protection Act, 2002, the Negligence Act (Ontario), and any other mandatory law — such as liability for negligence causing personal injury or death, for fraud, or for fundamental breach.
11 Changes to these Terms
We may update these Terms from time to time. The version in effect is the one posted on this page, identified by the latest version published on this page. Your continued use of the website or our services after an update means you accept the revised Terms. We encourage you to review this page periodically.
12 Governing law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict- of-laws principles. You agree that the courts of Ontario have exclusive jurisdiction, except where mandatory law provides otherwise.
