1Who is asking for your consent
The sender of these messages is Activate Beauty Medical Spa, operated by
ACTIVATE BEAUTY INC. (Ontario Corporation Number 1001218440)
(“Activate Beauty”, “we”, “us”), an aesthetic medicine clinic in
Bloor West Village, Toronto. Every message we send identifies us and gives you a way to stop,
as required by Canada’s Anti-Spam Legislation (CASL, s. 6(2) and s. 11). The details below are also what CASL s. 10 requires us to give you when we ask for your consent:
2The two kinds of messages we send
Care messages. These relate to an appointment you have already booked or a
treatment you have already had. They include:
- appointment confirmations, reminders and rescheduling notices;
- pre-treatment preparation instructions;
- post-treatment aftercare and follow-up;
- clinic notices, such as a closure, a delay or a change to your visit.
We may send care messages to any patient who has given us a mobile number, as part of providing
your care. They are not promotional and they are not sent to sell you anything.
Marketing messages. These include promotions, offers, news about treatments and
products, event invitations and clinic updates. We send them
only to people who have given express written consent to receive them.
Being our patient is not consent to marketing. Activate Beauty is a health information custodian under
Ontario’s Personal Health Information Protection Act, 2004 (PHIPA, s. 3),
and because your contact details sit in a record that also holds your health information, they form part of
your personal health information (s. 4(3)). PHIPA s. 33 does not let us use that
information to market to you without your express consent: the implied consent that lets us provide your
care does not extend to marketing. So we ask for marketing consent separately and explicitly.
3How you give consent
There are three ways to opt in, and all of them require a positive action by you:
- In the clinic. By signing our Marketing Consent form at your visit.
- On our website. By ticking the SMS box on a booking, intake or contact form. The box is never pre-ticked, and we never treat a blank box as consent.
- By text. By sending the word START to +1 (855) 485-2004.
Consent is never a condition of booking, of buying anything, or of receiving treatment. This is the
wording of the box you tick:
We keep a record of how and when each consent was given, so we can show it if you ask, or if a
regulator or a mobile carrier does.
4How to withdraw your consent
You can withdraw your consent at any time, at no cost, by any of these routes:
Replying STOP takes effect immediately and stops every text message on
that number, including appointment reminders. If you would rather keep your appointment reminders and
stop only the marketing, email or call us and we will set that up.
Withdrawing your consent will never affect your care. It does not affect your bookings,
your treatment, or how we look after you as a patient.
5Frequency and cost
Message frequency varies. Message and data rates may apply.
Activate Beauty does not charge you for these messages. Your mobile carrier may charge you for
receiving them, depending on your plan.
6Getting help
Reply HELP to any message from us and you will get our contact details
back. You can also email info@activatebeauty.ca or call
(416) 909-0713 during clinic hours.
7We do not share your number
Your phone number and SMS consent are not sold, shared, rented, released, or traded to third
parties for marketing or promotional purposes.
We use a messaging service provider under contract to deliver these messages. It may process your
number only on our instructions and only to send the messages you asked for. Some providers store or
process information outside Canada, including in the United States, where it may be accessible to
local courts and authorities under local law.
8Delivery is not guaranteed
Carriers are not liable for delayed or undelivered messages.
Text messaging depends on mobile networks we do not control. Please do not use text messaging for
anything urgent or for a medical emergency. If you have a medical emergency, call 911 or go to your
nearest emergency department.
9Your privacy and your information
We collect your name, your mobile number, and a record of the consent you gave (what you agreed to,
how, and when). We use that information only to send the messages described on this page. Our
Privacy Policy explains how we handle personal information under
PIPEDA and personal health information under PHIPA, how long we keep it, and
how to ask to see, correct or delete it.
